If someone needs to care for a close relative and would like to move into the same house, they can give notice to the current tenants on the grounds of personal use. This is the result of a ruling by the Munich Local Court (case no. 453 C 3432\/21). In this case, a grandniece took legal action against the tenants - an elderly couple - after pre-trial settlement negotiations failed and was ultimately successful.<\/p>\n
The great-niece undertook to help her great-aunt and great-uncle (both over 80 years old) with shopping, errands and visits to the doctor. In return, the great-aunt and great-uncle transferred an apartment to her in exchange for a monthly annuity of 800 euros.<\/p>\n
She justified the termination for personal use on the grounds that she had to pay EUR 1,300 rent for her 50-square-metre, two-bedroom apartment about three kilometers away, that she had been working from home since before the coronavirus and needed a study, and that she could quickly support her great-aunt and great-uncle in an emergency. The elderly couple who live in the apartment were therefore ordered to move out by the local court.<\/p>\n
