The legal implications of building acceptance should not be underestimated by builders. The Bauherren-Schutzbund points this out in an article. This is a decisive milestone in the construction process. The client confirms that the work is essentially complete and free of defects. This confirmation marks the end of the contract fulfillment stage and the start of the five-year warranty period for claims for defects.
The risk of damage to or destruction of the construction work due to external influences is transferred from the contractor to the client upon acceptance of the construction work. From this point onwards, the client must prove that any defects that occur later were caused by the contractor.
The building inspection can be carried out either by the client himself or by an authorized third party. However, it is advisable for builders to seek advice from an expert or an independent builder's consultant. According to the Bauherren-Schutzbund, builders should not rush into a building inspection and should seek advice from a qualified expert if necessary.
